On January 5, 2025, H.R. 82, the Social Security Fairness Act, was signed into law by President Biden. This measure eliminates the Windfall Elimination Provision (WEP) and Government Pension Offset (GPO), which reduced Social Security benefits for those who receive other pensions from state or local governments.

Since the new law will be retroactive to January 2024, those beneficiaries who did not receive full payments due to WEP and GPO since that time will have past-due benefits recalculated.

The Social Security Administration (SSA) will now determine how to implement the law. Initial information on implementation can be found here.
